GENERAL TERMS & CONDITIONS
Law Office mr T.O. Sohansingh, Amsterdam

  1. Advocatenkantoor T.O. Sohansingh is the trade name of mr T.O. Sohansingh, Attorney at Law, a limited liability firm, whose purpose it is to conduct the practise of attorney and civil law, in the broadest sense of the word. This practice is conducted by mr Sohansingh or persons, who are engaged by Advocatenkantoor mr T.O. Sohansingh in the performance of the assignments of its clients.

  2. These General Conditions are also applicable to supplemental and further assignments of clients. They are available in the Dutch and English language. In the case of any discrepancy as to the contents and purport of these conditions, the Dutch text will prevail.

  3. Not only Advocatenkantoor mr T.O. Sohansingh, but also all those who are involved in the performance of any assignment of a client, can invoke these General Conditions. The same applies to former associates including their respective heirs, if they are held liable after they have terminated their practice with Advocatenkantoor mr T.O. Sohansingh.

  4. All clients' assignments are considered by Advocatenkantoor mr T.O. Sohansingh to have been given to it as an organization, even if it is the express or implicit intent that an assignment will be performed by a specific person. The operation of article 7:404 of the Dutch Civil Code, which addresses the last mentioned case, and liability in those cases in which an assignment is given to two or more persons, is excluded.

  5. All clients' assignments are considered to have been given to office of Advocatenkantoor mr T.O. Sohansingh, even if it is the express or implicit intent that an assignment will be performed by a specific person. The force of article 7:404 of the Dutch Civil Code, which addresses the last mentioned situation, and the force of article 7.404 paragraph 2, which addresses liability in those cases in which an assignment is given to two or more persons, is excluded.

    If, by or in connection with the performance of an assignment of a client or otherwise, damage is caused to persons or property, for which Advocatenkantoor mr T.O. Sohansingh is liable, then the liability will be limited to the amount or amounts, to which the professional indemnity insurance taken out by Advocatenkantoor mr T.O. Sohansingh provides coverage including the franchise which Advocatenkantoor mr T.O. Sohansingh carries in connection with the insurance.

    The liability limitation, as described in the first and second paragraph, does not apply if there is intentional or gross negligence of Advocatenkantoor mr T.O. Sohansingh and / or its senior subordinated, which also refers to Advocatenkantoor mr T.O. Sohansingh connected lawyers and prosecutors.

  6. It is possible that persons engaged in connections with the performance of an assignment of a client may wish to limit their liability in connection therewith. Advocatenkantoor mr T.O. Sohansingh proceeds from the assumption and stipulates hereby that all assignments given to it by clients include the authority to accept such a limitation of liability also on behalf of those clients.

  7. If the performance of an assignment of a client entails the engagement of a person, who has no connection to Advocatenkantoor mr T.O. Sohansingh and is not involved in a cooperation entered into by Advocatenkantoor mr T.O. Sohansingh, Advocatenkantoor mr T.O. Sohansingh shall not be liable for failures of such person ion connection with its services in the context of the performance of the assignment.

  8. The scale of fees is indexed annually. All invoices presented by Advocatenkantoor mr T.O. Sohansingh must be paid within 14 days of the invoice date. If this term is exceeded, the client is in default and an interest charge for late payment, equivalent to the current legal rate of interest, shall be owed. If Advocatenkantoor mr T.O. Sohansingh are compelled to take measured to recover the amount owed from the client who is in default, the collection costs – including a minimum of 15 % if the outstanding amount - are for account of the client.

  9. The relationship between Advocatenkantoor mr T.O. Sohansingh and its clients will be governed by Dutch law.

  10. Any disputes that may arise in connection with the establishment and/or performance of our services, including all billing disputes, may be submitted to my complaints officer, Mr P.A H.Tjong-A-Hung.

    Internal complaints procedure
    If a client approaches the office with a complaint, the complaint will be forwarded to mr P.A H.Tjong-A-Hung (lawyer) having an office at Maldenhof 423, 1106 EM Amsterdam, email: mr.tjong@gmail.com, website: www.tjong-a-hung.nl, who thereby acts as a complaints officer.The complaints officer informs the person about whom the complaint has been made of the submission of the complaint and gives the complainant and the person against whom the complaint has been made the opportunity to provide an explanation of the complaint.The person about whom the complaint has been made tries to reach a solution together with the client, whether or not after the complaints officer has intervened.The complaints officer will deal with the complaint within four weeks of receipt of the complaint or, with reasons, will inform the complainant of any deviation from this period, stating the period within which an opinion on the complaint will be given.The complaints officer will inform the complainant and the person against whom the complaint has been made in writing of the opinion on the merits of the complaint, whether or not accompanied by recommendations.

    If the complaint has been handled satisfactorily, the complainant, the complaints officer and the person complained about will sign the judgment regarding the validity of the complaint.

    Confidentiality and free complaint handling
    The complaints officer and the person about whom the complaint has been made observe confidentiality during the handling of the complaint.
    The complainant does not owe any compensation for the costs of handling the complaint.

    Responsibilities
    The complaints officer is responsible for the timely handling of the complaint.
    The person about whom the complaint has been made keeps the complaints officer informed about any contact and a possible solution.
    The complaints officer will keep the complainant informed about the handling of the complaint.
    The complaints officer keeps the complaint file.

    Complaint registration
    The complaints officer registers the complaint and the subject of the complaint. A complaint can be divided into several subjects.
    The complaints officer periodically reports on the handling of the complaints and makes recommendations to prevent new complaints and to improve procedures.
    At least once a year, reports and recommendations are discussed at the office and submitted for decision-making.
